Welcome to Golden Hour.
By booking or purchasing a service with Golden Hour, you agree to the following Terms & Conditions.
These terms are intended to clearly explain how my services work and what you can expect from me. They apply to all doula and photography services unless otherwise stated in your individual Client Agreement.
Nothing in these terms is intended to exclude or limit your rights under the Australian Consumer Law.
1. About Golden Hour
Golden Hour is a Perth-based doula and photography business operated by Mon Hyde.
Golden Hour provides:
- Doula support
- Birth photography
- Maternity photography
- Newborn photography
- Family photography
- Other photography services as offered from time to time
2. Booking & Acceptance
A booking is confirmed once:
- You have completed the required booking information or agreement;
- You have accepted these Terms & Conditions; and
- The required booking fee or retainer has been paid.
By making a booking, you confirm that the information you provide is accurate and that you understand the services you are booking.
For doula and birth photography packages, your individual Doula & Birth Photography Agreement will also apply.
3. Doula & Birth Photography Services
Doula and birth photography services are provided as described in your individual package and agreement.
My role as a doula is to provide **emotional, physical and informational support** before, during and/or after birth, depending on the package you have selected.
Birth photography is provided alongside this support where included in your package.
I will make every reasonable effort to provide the services described in your agreement, but birth is inherently unpredictable and I cannot guarantee that every moment will be captured or that I will arrive before your baby is born.
4. Scope of Doula Practice
A doula provides non-clinical support.
I do not:
- Provide medical advice or diagnosis
- Perform clinical examinations
- Monitor fetal or maternal wellbeing
- Deliver babies
- Prescribe or administer medication
- Make decisions on behalf of you or your medical care team
- Replace your midwife, obstetrician, GP or other healthcare provider
You remain responsible for your healthcare decisions and should seek appropriate medical advice from your qualified healthcare provider.
My role is to support you, your choices and your experience without judgement.
5. Birth Plans & Birth Choices
Your birth may not go according to your original plan, and that's okay.
Whether you choose a hospital, birth centre, home birth, induction, epidural, caesarean or another birth pathway, I will support you within my role and the scope of your agreement.
I do not guarantee or promote a particular type of birth or outcome.
Free birth
Golden Hour does not provide doula or birth photography support for planned free births where a person intentionally chooses to birth without a qualified medical or midwifery care provider present.
Any decision to free birth after booking will be dealt with according to the terms of your individual agreement and Refund & Cancellation Policy.
6. Hospital & Birth Facility Policies
I will always respect the policies and requirements of your chosen hospital, birth centre or other birth facility.
If hospital or facility policies restrict my ability to provide support or photography, I will comply with those requirements.
This may include restrictions regarding photography, positioning, equipment or access to certain areas.
7. Backup Support
Birth can happen at any time.
If I am unable to attend your birth due to illness, emergency or another unavoidable circumstance, I will make reasonable efforts to arrange appropriate backup doula or photography support where possible.
Where backup support is arranged, the terms of your individual agreement will continue to apply.
8. Photography Services
Photography sessions are provided according to the package or session booked.
Photography does not guarantee a particular number of photographs, poses, backgrounds or outcomes unless specifically stated in your package or agreement.
My photographic style is part of the service you are booking. While I will take your preferences into consideration, I cannot guarantee that the final images will look identical to examples shown on my website or social media.
9. Image Selection & Editing
Golden Hour retains creative control over the final selection and editing of photographs.
Images are individually selected and professionally edited in accordance with my photographic style.
Unedited RAW files are not provided.
I do not provide unfinished, rejected or unedited photographs.
10. Image Collections
For photography sessions where images are purchased separately, the session fee does not include digital images unless specifically stated.
Image collections and their prices will be communicated to you at the time of booking or following your session.
Once an image collection has been selected and paid for, it cannot generally be changed unless agreed by Golden Hour.
11. Image Delivery
Final images will be delivered through an online gallery or another agreed method.
Delivery timeframes will vary depending on the type of session and current workload and will be communicated to you.
Once your gallery has been delivered, you are responsible for downloading and safely storing your images.
Golden Hour recommends keeping at least one backup copy of your photographs.
12. Copyright
Copyright in all photographs remains with Golden Hour / Mon Hyde unless otherwise agreed in writing.
Purchasing digital images gives you a personal licence to download, print and share your photographs for personal use.
You may not:
- Sell the photographs
- Alter or edit the photographs
- Apply filters that significantly change the photographs
- Use the photographs for commercial purposes
- Submit the photographs to competitions or publications commercially without permission
Commercial use requires written permission from Golden Hour.
13. Sharing Your Photographs
I understand that photographs of pregnancy, birth, newborns and families are deeply personal.
I will only use your photographs for marketing, social media, website, portfolio or promotional purposes with your permission.
Your individual photography agreement will include the relevant image-sharing consent.
You are never required to agree to your images being publicly shared in order to book a session.
14. Client Responsibilities
You agree to:
- Provide accurate information when booking;
- Arrive on time for photography sessions;
- Follow reasonable instructions during your session;
- Inform me of relevant changes to your circumstances;
- Inform me as soon as possible if you need to cancel or reschedule;
- Obtain any necessary permissions for photography at your chosen location;
- Treat Golden Hour and any backup providers with respect.
For birth services, you are responsible for informing your maternity care provider and birth facility that you have engaged a doula and/or birth photographer where appropriate.
15. Children & Family Sessions
Parents or legal guardians remain responsible for their children throughout photography sessions.
Golden Hour is not responsible for supervising children during a session.
For newborn sessions, parents remain responsible for their baby's safety and wellbeing at all times.
I will never place a baby or child in a position that I believe is unsafe.
16. Payment
All prices are quoted in Australian dollars unless otherwise stated.
Payment deadlines will be outlined in your individual agreement or invoice.
If an agreed payment is not received by the due date, Golden Hour may contact you to arrange payment or discuss the booking.
Additional fees or cancellation provisions may apply where specified in your individual agreement.
17. Travel
Some services may include travel within Golden Hour's standard service area.
Where travel fees apply, these will be communicated before booking.
Travel fees may vary depending on the location and type of service.
18. Cancellation & Refunds
Cancellation, refund and rescheduling terms are outlined in the Golden Hour Refund & Cancellation Policy.
By booking with Golden Hour, you agree to those terms in addition to these Terms & Conditions.
Where there is any inconsistency between these Terms & Conditions and your individual Client Agreement, your individual agreement will apply to the extent of that inconsistency.
Your rights under Australian Consumer Law are not affected.
19. Illness & Safety
For the safety of clients, babies, families and myself, I may recommend postponing a session or service if someone involved is experiencing a contagious illness or if conditions are unsafe.
Please let me know as soon as possible if you or someone in your household is unwell.
I will always aim to find a suitable alternative where possible.
20. Unforeseen Circumstances
Golden Hour will not be responsible for delays or inability to provide a service where circumstances are outside my reasonable control.
This may include:
- Serious illness
- Emergencies
- Natural disasters
- Severe weather
- Government restrictions
- Unexpected birth circumstances
- Hospital restrictions
- Other circumstances making the service impossible or unsafe
Where possible, I will communicate with you and work towards a reasonable alternative.
21. Liability
Golden Hour takes reasonable care when providing all services.
However, I cannot guarantee specific birth outcomes, photography results or that every moment of a birth will be captured.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded under Australian Consumer Law.
22. Privacy
Your personal information will be handled in accordance with the Golden Hour Privacy Policy.
I will only collect and use personal information as reasonably required to provide your services, communicate with you, manage your booking and operate my business.
23. Changes to These Terms
Golden Hour may update these Terms & Conditions from time to time.
The version that applies to your booking will be the version in effect when you make your booking, unless otherwise required by law.
24. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies available to you under the Australian Consumer Law.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
